Sta-Rite Industries(Wake Co. Superior Ct., NC, 1996)&lt;br /&gt;&lt;br /&gt;This is the summary: A 5-year-old girl was disemboweled, but survived, after being caught and suctioned by a wading pool's defective drain. Despite 12 prior suits with similar claims, the manufacturer continued to make and sell drain covers lacking warnings.&lt;br /&gt;&lt;br /&gt;This was the outcome: A $25 million settlement.&lt;br /&gt;&lt;br /&gt;Are settlements like that too high? I think they are too low. The people that let a child get hurt like this long after the danger is apparent should live in fear of losing everything.&lt;br /&gt;&lt;br /&gt;If it was my kid, I'd want the money for the round-the-clock care she would need for the rest of her life, and I'd also want something more: for the people who knowingly let this happen to go to jail forever and ever and ever.&lt;br /&gt;&lt;br /&gt;So, the next time I hear someone say &lt;em&gt;trial lawyer&lt;/em&gt; like it's a bad thing, I'll be ready to say what's on my mind.&lt;br /&gt;&lt;br /&gt;It's simple, really.&lt;br /&gt;&lt;br /&gt;You can be on the side that helps people who are injured, or you can be on the side of people who intentionally let children be disemboweled in pools.&lt;br /&gt;&lt;br /&gt;I know which side I'm on.&lt;br /&gt;&lt;br /&gt;And, for the record, my father was a &lt;em&gt;trial lawyer&lt;/em&gt; We must stop now</title><content type='html'>&lt;strong&gt;Beyond Vietnam: A Time to Break Silence&lt;br /&gt;&lt;/strong&gt;By Rev. Martin Luther King 4 April 1967&lt;br /&gt;&lt;em&gt;Speech delivered by Dr. Martin Luther King, Jr., on April 4, 1967, at a meeting of Clergy and Laity Concerned at Riverside Church in New York City&lt;/em&gt;&lt;br /&gt;&lt;br /&gt;Somehow this madness must cease.&lt;br /&gt;&lt;br /&gt;We must stop now.&lt;br /&gt;&lt;br /&gt;I speak as a child of God and brother to the suffering poor of Vietnam.&lt;br /&gt;&lt;br /&gt;I speak for those whose land is being laid waste, whose homes are being destroyed, whose culture is being subverted.&lt;br /&gt;&lt;br /&gt;I speak for the poor of America who are paying the double price of smashed hopes at home and death and corruption in Vietnam.&lt;br /&gt;&lt;br /&gt;I speak as a citizen of the world, for the world as it stands aghast at the path we have taken.&lt;br /&gt;&lt;br /&gt;I speak as an American to the leaders of my own nation.&lt;br /&gt;&lt;br /&gt;The great initiative in this war is ours. The initiative to stop it must be ours.&lt;br /&gt;&lt;br /&gt;This is the message of the great Buddhist leaders of Vietnam. Recently one of them wrote these words:&lt;br /&gt;&lt;br /&gt;"Each day the war goes on the hatred increases in the heart of the Vietnamese and in the hearts of those of humanitarian instinct. The Americans are forcing even their friends into becoming their enemies. It is curious that the Americans, who calculate so carefully on the possibilities of military victory, do not realize that in the process they are incurring deep psychological and political defeat. Fried Diet Coke&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;Fri Oct 27, 8:34 AM ET / Reuters&lt;br /&gt;A new fast food is making its debut at U.S. fairs this fall -- fried Coke.&lt;br /&gt;&lt;br /&gt;Abel Gonzales, 36, a computer analyst from Dallas, tried about 15 different varieties before coming up with his perfect recipe -- a batter mix made with Coca-Cola syrup, a drizzle of strawberry syrup, and some strawberries.&lt;br /&gt;&lt;br /&gt;Balls of the batter are then deep-fried, ending up like ping-pong ball sized doughnuts which are then served in a cup, topped with Coca-Cola syrup, whipped cream, cinnamon sugar and a cherry on the top.&lt;br /&gt;&lt;br /&gt;Gonzales ran two stands at the State Fair of Texas and sold up to 35,000 fried Cokes over 24 days for $4.50 each -- and won a prize for coming up with "most creative" new fair food.&lt;br /&gt;Now other fairs in North Carolina and Arizona are following the trend, and other people are trying to emulate Gonzales' recipe.&lt;br /&gt;&lt;br /&gt;Gonzales didn't say how many calories  are in his creation. He did say he wouldn't  patent it.&lt;br /&gt;"The best I can hope for is that it's the original and hopefully the best fried Coke out there," he said.&lt;br /&gt;&lt;br /&gt;But Gonzales said the success of his fried Coke had inspired him. Next year's fair-goers can look forward to fried Sprite or -- for those watching their weight -- fried diet Coke.&lt;br /&gt;"We are trying to cut a lot of the sugar out of it. It has less calories but it's still very, very sweet," he said.&lt;br /&gt;&lt;br /&gt;Ray Crockett, a spokesman for Coca-Cola Co., said: "We're constantly amazed at the creative ways folks find to enjoy their Coke and make it part of celebrations like fairs and festivals. "The Iraq conflict," it said, "has become the cause célèbre for jihadists, breeding a deep resentment of US involvement in the Muslim world and cultivating supporters for the global jihadist movement."&lt;br /&gt;&lt;br /&gt;Not only is the Iraq war inspiring terrorism, but the jihadist movement has metastasized into spontaneously generated cells apart from the original al-Qaida organization, which itself is vastly reduced. And for 40 days after the attacks, I worked here again, trying to make sense of what happened, and was yet to happen, as a reporter.&lt;br /&gt;&lt;br /&gt;All the time, I knew that the very air I breathed contained the remains of thousands of people, including four of my friends, two in the planes and -- as I discovered from those "missing posters" seared still into my soul -- two more in the Towers.&lt;br /&gt;&lt;br /&gt;And I knew too, that this was the pyre for hundreds of New York policemen and firemen, of whom my family can claim half a dozen or more, as our ancestors.&lt;br /&gt;&lt;br /&gt;I belabor this to emphasize that, for me this was, and is, and always shall be, personal.&lt;br /&gt;And anyone who claims that I and others like me are "soft,"or have "forgotten" the lessons of what happened here is at best a grasping, opportunistic, dilettante and at worst, an idiot whether he is a commentator, or a Vice President, or a President.&lt;br /&gt;&lt;br /&gt;However, of all the things those of us who were here five years ago could have forecast -- of all the nightmares that unfolded before our eyes, and the others that unfolded only in our minds -- none of us could have predicted this.&lt;br /&gt;&lt;br /&gt;Five years later this space is still empty.&lt;br /&gt;&lt;br /&gt;Five years later there is no memorial to the dead.&lt;br /&gt;&lt;br /&gt;Five years later there is no building rising to show with proud defiance that we would not have our America wrung from us, by cowards and criminals.&lt;br /&gt;&lt;br /&gt;Five years later this country's wound is still open.&lt;br /&gt;&lt;br /&gt;Five years later this country's mass grave is still unmarked.&lt;br /&gt;&lt;br /&gt;Five years later this is still just a background for a photo-op.&lt;br /&gt;&lt;br /&gt;It is beyond shameful.&lt;br /&gt;&lt;br /&gt;At the dedication of the Gettysburg Memorial -- barely four months after the last soldier staggered from another Pennsylvania field -- Mr. Lincoln said, "we cannot dedicate, we cannot consecrate, we cannot hallow this ground. The brave men, living and dead, who struggled here, have consecrated it, far above our poor power to add or detract."&lt;br /&gt;&lt;br /&gt;Lincoln used those words to immortalize their sacrifice.&lt;br /&gt;&lt;br /&gt;Today our leaders could use those same words to rationalize their reprehensible inaction. "We cannot dedicate, we can not consecrate, we can not hallow this ground." So we won't.&lt;br /&gt;&lt;br /&gt;Instead they bicker and buck pass. They thwart private efforts, and jostle to claim credit for initiatives that go nowhere. They spend the money on irrelevant wars, and elaborate self-congratulations, and buying off columnists to write how good a job they're doing instead of doing any job at all.&lt;br /&gt;&lt;br /&gt;Five years later, Mr. Bush, we are still fighting the terrorists on these streets. And look carefully, sir, on these 16 empty acres. The terrorists are clearly, still winning.&lt;br /&gt;&lt;br /&gt;And, in a crime against every victim here and every patriotic sentiment you mouthed but did not enact, you have done nothing about it.&lt;br /&gt;&lt;br /&gt;And there is something worse still than this vast gaping hole in this city, and in the fabric of our nation. There is its symbolism of the promise unfulfilled, the urgent oath, reduced to lazy execution.&lt;br /&gt;&lt;br /&gt;The only positive on 9/11 and the days and weeks that so slowly and painfully followed it was the unanimous humanity, here, and throughout the country. The government, the President in particular, was given every possible measure of support.&lt;br /&gt;&lt;br /&gt;Those who did not belong to his party -- tabled that.&lt;br /&gt;&lt;br /&gt;Those who doubted the mechanics of his election -- ignored that.&lt;br /&gt;&lt;br /&gt;Those who wondered of his qualifications -- forgot that.&lt;br /&gt;&lt;br /&gt;History teaches us that nearly unanimous support of a government cannot be taken away from that government by its critics. It can only be squandered by those who use it not to heal a nation's wounds, but to take political advantage.&lt;br /&gt;&lt;br /&gt;Terrorists did not come and steal our newly-regained sense of being American first, and political, fiftieth. Nor did the Democrats. Nor did the media. Nor did the people.&lt;br /&gt;&lt;br /&gt;The President -- and those around him -- did that.&lt;br /&gt;&lt;br /&gt;They promised bi-partisanship, and then showed that to them, "bi-partisanship" meant that their party would rule and the rest would have to follow, or be branded, with ever-escalating hysteria, as morally or intellectually confused, as appeasers, as those who, in the Vice President's words yesterday, "validate the strategy of the terrorists."&lt;br /&gt;&lt;br /&gt;They promised protection, and then showed that to them "protection" meant going to war against a despot whose hand they had once shaken, a despot who we now learn from our own Senate Intelligence Committee, hated al-Qaida as much as we did.&lt;br /&gt;&lt;br /&gt;The polite phrase for how so many of us were duped into supporting a war, on the false premise that it had 'something to do' with 9/11 is "lying by implication."&lt;br /&gt;&lt;br /&gt;The impolite phrase is "impeachable offense."&lt;br /&gt;&lt;br /&gt;Not once in now five years has this President ever offered to assume responsibility for the failures that led to this empty space, and to this, the current, curdled, version of our beloved country.&lt;br /&gt;&lt;br /&gt;Still, there is a last snapping flame from a final candle of respect and fairness: even his most virulent critics have never suggested he alone bears the full brunt of the blame for 9/11.&lt;br /&gt;&lt;br /&gt;Half the time, in fact, this President has been so gently treated, that he has seemed not even to be the man most responsible for anything in his own administration.&lt;br /&gt;&lt;br /&gt;Yet what is happening this very night?&lt;br /&gt;&lt;br /&gt;A mini-series, created, influenced -- possibly financed by -- the most radical and cold of domestic political Machiavellis, continues to be televised into our homes.&lt;br /&gt;&lt;br /&gt;The documented truths of the last fifteen years are replaced by bald-faced lies; the talking points of the current regime parroted; the whole sorry story blurred, by spin, to make the party out of office seem vacillating and impotent, and the party in office, seem like the only option.&lt;br /&gt;&lt;br /&gt;How dare you, Mr. President, after taking cynical advantage of the unanimity and love, and transmuting it into fraudulent war and needless death, after monstrously transforming it into fear and suspicion and turning that fear into the campaign slogan of three elections? How dare you -- or those around you -- ever "spin" 9/11?&lt;br /&gt;&lt;br /&gt;Just as the terrorists have succeeded -- are still succeeding -- as long as there is no memorial and no construction here at Ground Zero.&lt;br /&gt;&lt;br /&gt;So, too, have they succeeded, and are still succeeding as long as this government uses 9/11 as a wedge to pit Americans against Americans.&lt;br /&gt;&lt;br /&gt;This is an odd point to cite a television program, especially one from March of 1960. But as Disney's continuing sell-out of the truth (and this country) suggests, even television programs can be powerful things.&lt;br /&gt;&lt;br /&gt;And long ago, a series called "The Twilight Zone" broadcast a riveting episode entitled "The Monsters Are Due On Maple Street."&lt;br /&gt;&lt;br /&gt;In brief: a meteor sparks rumors of an invasion by extra-terrestrials disguised as humans. The electricity goes out. A neighbor pleads for calm. Suddenly his car -- and only his car -- starts. Someone suggests he must be the alien. Then another man's lights go on. As charges and suspicion and panic overtake the street, guns are inevitably produced. An "alien" is shot -- but he turns out to be just another neighbor, returning from going for help.&lt;br /&gt;&lt;br /&gt;The camera pulls back to a near-by hill, where two extra-terrestrials are seen manipulating a small device that can jam electricity. The veteran tells his novice that there's no need to actually attack, that you just turn off a few of the human machines and then, "they pick the most dangerous enemy they can find, and it's themselves."&lt;br /&gt;&lt;br /&gt;And then, in perhaps his finest piece of writing, Rod Serling sums it up with words of remarkable prescience, given where we find ourselves tonight: "The tools of conquest do not necessarily come with bombs and explosions and fallout. There are weapons that are simply thoughts, attitudes, prejudices, to be found only in the minds of men."&lt;br /&gt;&lt;br /&gt;"For the record, prejudices can kill and suspicion can destroy, and a thoughtless, frightened search for a scapegoat has a fallout all its own -- for the children, and the children yet unborn."&lt;br /&gt;&lt;br /&gt;When those who dissent are told time and time again -- as we will be, if not tonight by the President, then tomorrow by his portable public chorus -- that he is preserving our freedom, but that if we use any of it, we are somehow un-American ... MARGIN: 0px 10px 10px 0px; CURSOR: hand" alt="" src="http://photos1.blogger.com/blogger/870/3230/320/dtd.jpg" border="0" /&gt;&lt;/a&gt;I was updating my resume when I fell into remembering the pioneering digital skunkworks in TriBeCa where I walked through the door to the Internet, before the information highway was a going concern, back in the day.&lt;br /&gt;&lt;br /&gt;The office was across the street from a bookstore/cafe that sold dark coffee all day, fresh bagels in the morning, and turkey-apple-brie sandwiches on chewy sourdough bread for lunch.&lt;br /&gt;&lt;br /&gt;Back then, nobody knew from content strategists and content providers, and the place was filled with writers and editors. I was one. War brings war.&lt;br /&gt;&lt;br /&gt;Peace brings peace.&lt;br /&gt;&lt;br /&gt;And while I believe, as the Israelis say, that there is no negotiating with people who want to drive you into the sea, I also think Israel could have better responded to the latest Hezbollah attacks by reaching out to the world instead of immediately going with the boom, boom, boom.&lt;br /&gt;&lt;br /&gt;What if Israel IM'ed the world and said this: &lt;em&gt;Look.&lt;/em&gt; &lt;em&gt;Those people fired rockets at us. Again. It's the latest step in a longrunning, bitter fight. There are wrongs and grievances on all sides. We know that. We just want the killing to end. We want peace. What do you think we should do? What would you do? Will you help? Now?&lt;br /&gt;&lt;/em&gt;&lt;br /&gt;What could it hurt?&lt;br /&gt;&lt;br /&gt;Best case scenario: The world responds with loud, strong support for the violence to end on all sides, and peace brings peace.&lt;br /&gt;&lt;br /&gt;Worst case: There's always the boom, boom, boom.&lt;br /&gt;&lt;br /&gt;I also have a two-part reconstruction program for the Middle East that is part secret weapon, part psyops, and part economics.&lt;br /&gt;&lt;br /&gt;The secret weapon/psyops part is really pretty easy. Just carpet the area with high end wireless laptops loaded with unlimited free access and PayPal accounts stocked with, oh, $500 USD cash. Presto! Now the unemployed young men who turn out by the thousands to protest their many real grievances and blame, well, the Jews, will turn their attention to what really matters: downloading porn, making MySpace pages, shopping online, and finding out what's up with Britney and K-Fed.&lt;br /&gt;&lt;br /&gt;The economics part is a continuation of the secret weapon/psyops program: Do everything possible to help those unemployed young men spend their time making money and shopping instead. The women too, for that matter. Get them out of the house. MARGIN: 0px 10px 10px 0px; CURSOR: hand" alt="" src="http://photos1.blogger.com/blogger/870/3230/320/smokestack.1.jpg" border="0" /&gt;&lt;/a&gt;I have some questions about the people who pretend climate crisis is not the growing disasater it is, and if it will be too late to change directions when they realize how badly they are being duped.&lt;br /&gt;&lt;br /&gt;&lt;p&gt;First, a statement of rational if reprehensible behavior: If you are the president of Exxon, and you're getting paid a billion dollars to deny that what you do when you go to work every day is damaging the future of every living thing on the planet, you're just protecting your very very very large paycheck. While that's not honorable, decent or nice, it does fit into some kind of framework of putting your bank account first, and the hell with everyone else.&lt;/p&gt;&lt;p&gt; But what is driving the angry, ranting, barely coherent people -- see the Amazon.com comments on Al Gore's "An Inconvenient Truth," for plenty of examples -- who are not getting paid a billlion dollars to deny what is happening to the planet before our very eyes? Discuss:&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Similarities: &lt;/strong&gt;The propaganda point that "fighting them over there means that we won't have to fight them here" corresponds very closely to the "domino theory" of why we had to stop Communism in Vietnam before it spread somehow across the ocean.&lt;br /&gt;&lt;br /&gt;&lt;p&gt;While it is true that there are now a great many more Vietnamese restaurants in the US outside of major cities than there used to be, I think the owners and their families are generally not attempting to spread Communism here.&lt;/p&gt;&lt;p&gt;Meanwhile, in Iraq, we are making enemies faster than we can kill them, as the bumper sticker says, which actually increases the possibility that we will have to fight them here the longer we stay there.&lt;/p&gt;&lt;strong&gt;Differences: &lt;/strong&gt;People who want the Iraq misadventure to end don't hold it against the troops, as people mistakenly did in Vietnam; that's a good thing.
